PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING. By clicking “I Agree and Proceed,” creating an account, submitting any data or biological material, or otherwise using the MySpawn platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
These Terms constitute a binding legal agreement between you (“User”) and MySpawn, its affiliates, successors, and assigns.
MySpawn operates a digital legacy planning and long-term preservation platform. The Service enables Users to record, upload, store, and manage personal preferences, data archives, and biological samples (such as DNA) for potential future use.
MySpawn does not offer, provide, or perform any medical, genetic engineering, reproductive, cloning, gestation, or descendant-creation services. All selections made on the platform are conceptual only.
Any potential future realization of User preferences depends entirely on future scientific, technological, ethical, and regulatory developments.
You expressly acknowledge that MySpawn makes no guarantees, warranties, or representations regarding the creation, instantiation, revival, or development of any descendant, biological continuation, clone, or genetically modified entity.
Stored biological samples and data may never be used for reproductive or generative purposes. Any future use is strictly contingent upon applicable laws at the relevant time.
All services and materials are provided on an "AS IS" and "AS AVAILABLE" basis.
By proceeding, you represent that you are at least 18 years of age and have full legal capacity to enter into this agreement.
Your selections, including any death-triggered activation protocols, are non-binding expressions of preference only and do not create any obligation on MySpawn to act upon them.
You agree to obtain independent legal advice regarding estate planning, trusts, or posthumous instructions.
You retain ownership of your DNA sample and all uploaded data. MySpawn stores biological samples solely for preservation purposes and does not perform genetic analysis, modification, or reproduction.
In the event of your death, materials may be released only in accordance with verified legal instructions or court orders.
To the maximum extent permitted by law, MySpawn shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the Service, loss of data, or inability to realize any User preferences.
You agree to indemnify and hold harmless MySpawn from any claims, liabilities, or expenses arising from your use of the Service or violation of these Terms.
These Terms shall be governed by the laws of the State of Delaware, USA, except where mandatory consumer protections apply.
By proceeding, you confirm that you understand the speculative nature of this Service and the complete absence of guarantees regarding future outcomes. You accept all risks and will consult qualified legal counsel for any binding estate or trust matters.
